1. Acceptance of Terms

By accessing and using FileShare (the Service), you accept these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users, including individuals and organizations that create accounts, upload files, or access shared content.

2. Service Description

FileShare is a secure file sharing and collaboration platform that provides:

  • File storage and sharing with strong encryption
  • Two encryption modes: End-to-End and Server-Side
  • Role-based access control for company workspaces
  • Shareable links with expiry and download limits
  • Cross-platform applications for desktop, mobile, and web
  • Team collaboration features including audit logs, support, and account security controls

3. User Responsibilities

When using FileShare, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your credentials
  • Use strong passwords and available security controls
  • Notify us promptly about unauthorized access
  • Comply with applicable laws and regulations
  • Respect third-party rights and intellectual property

4. Prohibited Uses

You may not use FileShare to:

  • Upload or share illegal content or content that violates third-party rights
  • Distribute malware, viruses, or malicious code
  • Disrupt or interfere with the Service
  • Attempt unauthorized access to other accounts or files
  • Spam, harass, or harm others
  • Resell or redistribute the Service without authorization

5. Data Ownership and Encryption

You own your data. FileShare does not claim ownership of files, content, or data you upload to the Service.

End-to-End Encryption:

Files encrypted in E2E mode are encrypted on your device before upload. FileShare cannot decrypt or read those files.

If you lose your encryption keys, we cannot recover E2E encrypted files.

Server-Side Encryption:

Files in server-side mode are encrypted after upload using platform-managed keys. This mode supports controlled sharing and operational processing.

6. Payment Terms

FileShare offers multiple subscription plans with different pricing and operational limits.

  • Subscriptions are billed monthly or yearly through Stripe
  • Subscriptions renew automatically unless cancelled before renewal
  • We may update pricing with prior notice where required
  • Taxes and local charges may apply

7. Service Availability and Limits

We aim for a reliable service, but FileShare is provided as is and uninterrupted access cannot be guaranteed.

  • Scheduled and emergency maintenance may occur
  • Capacity limits tied to your plan are enforced
  • Features may change as the product evolves

8. Termination

You may cancel your account according to your plan and billing settings. We may suspend or terminate accounts that violate these Terms, fail payment obligations, or create security risk.

9. Limitation of Liability

To the maximum extent permitted by law, FileShare and its operators are not liable for indirect, incidental, or consequential damages, loss of data, or loss of business opportunity arising from use of the Service.

10. Data Backup and Recovery

While we operate backups of platform systems, you remain responsible for retaining copies of your important files and protecting your encryption keys and credentials.

11. Dispute Resolution

You agree to contact us first for informal resolution. If that fails, disputes may be handled under the applicable process required by law and contract.

12. Changes to These Terms

We may update these Terms to reflect product, legal, or business changes. Material changes will be communicated before taking effect where required.

13. Governing Law

These Terms are governed by the laws applicable to the entity operating FileShare, without regard to conflict-of-law principles.
